Another regular document that Mr. Blahnik prepares is a "Transfer Upon Death Deed," which will transfer someone's home to another individual upon the death of the homeowner. This is often times used as a method for elderly parents to transfer their house to their children at the time of their death. In such a situation, the children would receive a "stepped up" basis in the property and would not have to pay capital gains on the increase in the value of the property prior to the death of the parents.

There tends to be a resistance by so many people to avoid planning for their death. However, it is extremely important. Even if one's probate estate is rather small, a big accomplishment in the preparation of a Will is to name a "personal representative" to administer that person's estate when he or she dies.
